TERMS AND CONDITIONS
Welcome to Stardust Photobooths! These Terms and Conditions govern all bookings and services provided by Stardust Photobooths.
By making a booking and paying the required deposit, you acknowledge that you have read and agree to these Terms and Conditions, subject to any rights that cannot lawfully be excluded under Australian Consumer Law.
1. BOOKINGS AND CONFIRMATION
1.1 All bookings are subject to availability and acceptance by Stardust Photobooths.
1.2 A booking is confirmed once the client has provided the required booking information, accepted these Terms and Conditions, and paid the required 50% deposit.
1.3 The client is responsible for providing accurate information regarding the event date, venue, location, operating hours and any special requirements.
1.4 Any changes to the original booking must be communicated to Stardust Photobooths as soon as possible and are subject to approval.
1.5 Stardust Photobooths reserves the right to decline a booking where the venue, setup conditions, access arrangements or other circumstances make the safe and satisfactory provision of services impractical.
2. PRICING, DEPOSIT AND PAYMENT
2.1 Booking Deposit
A deposit equal to 50% of the total booking fee is required to secure your booking. Your booking will not be confirmed until the deposit has been received.
2.2 Non-Refundable Deposit
The 50% booking deposit is non-refundable if the client cancels the booking. The deposit secures the event date and time and compensates Stardust Photobooths for reserving the date and potentially declining other bookings.
This condition is subject to any rights or remedies the client may have under applicable Australian Consumer Law.
2.3 Remaining Balance
The remaining 50% balance must be paid in full no later than one day before the scheduled event date.
If payment is not received by the due date, Stardust Photobooths may contact the client to arrange payment and may suspend or cancel the booking where legally permitted.
2.4 Additional Charges
Additional services, approved overtime, travel expenses or other agreed charges may be invoiced separately.
The client will be informed of applicable additional charges before they are incurred wherever reasonably practicable.
2.5 Payment Responsibility
The client is responsible for ensuring all payments are made by the applicable due dates.
3. CANCELLATIONS BY THE CLIENT
3.1 If the client wishes to cancel a booking, they must notify Stardust Photobooths in writing as soon as possible.
3.2 The 50% deposit is non-refundable in the event of client cancellation, subject to applicable law.
3.3 If the client has paid the full booking fee and subsequently cancels, Stardust Photobooths will assess any refund due, taking into account the deposit, the timing of the cancellation, services already provided, reasonable costs incurred and any applicable legal obligations.
3.4 Any cancellation charges beyond the deposit will be reasonable and proportionate to the losses or costs arising from the cancellation, rather than punitive.
3.5 Where a refund is payable, it will be processed within a reasonable period.
3.6 Stardust Photobooths may consider alternative arrangements for cancellations arising from exceptional circumstances. Any agreed exception must be confirmed in writing.
Nothing in this section excludes or limits any rights the client has under Australian Consumer Law.
4. CANCELLATIONS BY STARDUST PHOTOBOOTHS
4.1 If Stardust Photobooths must cancel a booking and cannot provide the agreed service or an acceptable alternative, the client will receive a refund of payments made for the service that cannot be provided, subject to applicable law.
4.2 Stardust Photobooths will notify the client as soon as reasonably practicable if a cancellation becomes necessary.
4.3 Where possible, Stardust Photobooths may offer an alternative date, replacement service or other mutually agreed arrangement.
4.4 Nothing in this section limits the client’s rights under Australian Consumer Law.
5. RESCHEDULING AND CHANGES TO BOOKINGS
5.1 Requests to change the event date, venue, operating hours or package must be made in writing.
5.2 All changes are subject to availability and approval by Stardust Photobooths.
5.3 If a booking is rescheduled, the deposit may be transferred to the new date if Stardust Photobooths approves the change.
5.4 Additional costs may apply if rescheduling results in increased travel, equipment, staffing or other operational expenses. Any additional charges will be communicated to the client before the change is confirmed.
5.5 If Stardust Photobooths cannot accommodate the requested changes, the original booking arrangements will remain in place unless both parties agree otherwise.
6. SETUP REQUIREMENTS, VENUE ACCESS AND CLIENT RESPONSIBILITIES
To ensure a smooth and successful event, the client must ensure the following requirements are met.
6.1 Required Setup Space
The client must provide a flat, stable and unobstructed area measuring at least 3 metres by 3 metres for the photobooth and backdrop setup.
The area must be suitable for the safe operation of the equipment and remain accessible throughout the booking.
6.2 Power Supply
A reliable and functioning 10-amp power point must be available within a suitable distance of the setup area.
The power supply must be accessible for the duration of the photobooth service.
6.3 Indoor Use and Backdrop Placement
Our photobooths are designed for indoor use only.
The photobooth must be positioned in a suitable indoor location, and the backdrop must be positioned against a wall to allow for safe and secure setup.
Outdoor use is not permitted unless expressly approved by Stardust Photobooths in writing beforehand.
6.4 Elevated Locations and Lift Access
If the setup location is on an elevated level or requires equipment to be transported between floors, a suitable and accessible lift must be available.
The client must advise Stardust Photobooths in advance of any access restrictions, stairs, loading requirements or other conditions that may affect equipment transport.
6.5 Setup and Pack-Down Times
The client and venue must allow sufficient access time for our team to install, test, dismantle and remove the equipment.
The required access periods are:
Setup: 1.5 to 2 hours before the scheduled photobooth service start time.
Pack-down: Up to 1 hour after the scheduled service finish time.
These periods are separate from the booked photobooth operating hours and are not additional hours of guest-facing service.
The client is responsible for ensuring the venue permits access during these periods.
6.6 Venue Approval and Coordination
The client must obtain any necessary venue approvals and ensure the venue is aware of the space, power, indoor-use, backdrop, lift-access, setup and pack-down requirements.
Any restrictions that could affect the booking must be communicated to Stardust Photobooths before the event.
6.7 Failure to Meet Setup Requirements
If the required space, power supply, access or other essential setup conditions are unavailable, Stardust Photobooths will make reasonable efforts to work with the client to resolve the issue.
If the equipment cannot be safely installed or operated, Stardust Photobooths may be unable to provide the service as planned. Any resulting cancellation, refund or other remedy will be handled in accordance with these Terms and Conditions and applicable law.
7. HIRE DURATION AND OVERTIME
7.1 Booked Service Hours
The photobooth will operate during the hours specified in the booking confirmation.
Setup and pack-down periods are separate from the booked operating hours.
7.2 Overtime Charges
Any approved extension of the photobooth service beyond the scheduled finish time will be charged at $250 per additional hour.
Overtime is subject to the availability of Stardust Photobooths and the operator’s approval on the day.
7.3 Approval of Overtime
The client must obtain approval from the Stardust Photobooths operator before extending the service.
Overtime cannot be guaranteed, as the operator may have other commitments or may be restricted by venue requirements, safety considerations or other operational circumstances.
7.4 Overtime Payment
Any overtime charges must be paid in accordance with the payment arrangements advised by Stardust Photobooths.
8. EQUIPMENT CARE, DAMAGE AND SAFETY
8.1 All photobooth equipment, backdrops, props, printers, cameras and accessories remain the property of Stardust Photobooths unless otherwise agreed in writing.
8.2 The client must take reasonable steps to ensure that the equipment is used safely and appropriately.
8.3 Guests must not deliberately misuse, tamper with, move, dismantle or interfere with the equipment.
8.4 The client may be held responsible for the reasonable cost of repairing or replacing equipment where damage or loss is caused by the client, their guests or other persons under their control, to the extent permitted by law.
8.5 The client will not be responsible for ordinary wear and tear or damage caused by Stardust Photobooths or circumstances outside the client’s reasonable control.
8.6 Stardust Photobooths may temporarily suspend operation if equipment is being misused or if continuing to operate would create a safety risk.
8.7 Where reasonably practicable, the operator will inform the client of any issue and provide an opportunity for it to be resolved before suspending the service.
9. PHOTOBOOTH OPERATION AND TECHNICAL ISSUES
9.1 Stardust Photobooths will take reasonable care to ensure the equipment is installed and operated correctly.
9.2 Although we make reasonable efforts to provide a reliable service, technical issues may occasionally occur due to equipment malfunction, software problems, printer issues, power interruptions, internet connectivity or other circumstances.
9.3 If a technical issue occurs, Stardust Photobooths will make reasonable efforts to resolve it as quickly as practicable.
9.4 If a significant technical failure prevents the agreed service from being delivered, Stardust Photobooths will discuss an appropriate remedy with the client, taking into account the circumstances, the service delivered and applicable legal obligations.
9.5 Stardust Photobooths is not responsible for interruptions caused by venue power failures, restricted access, third-party internet services or other circumstances outside its reasonable control, except where responsibility cannot lawfully be excluded.
10. PRINTS, DIGITAL IMAGES AND PACKAGE INCLUSIONS
10.1 The prints, digital images, props, backdrops and other inclusions provided will depend on the package selected and confirmed at the time of booking.
10.2 Only the inclusions expressly stated in the booking confirmation or invoice are guaranteed.
10.3 Any additional prints, copies, operating hours or other services requested by the client may incur additional charges.
10.4 The client should advise Stardust Photobooths before the event of any specific requirements relating to print layouts, branding, logos or image templates.
10.5 Digital image delivery methods and availability will depend on the package selected and the arrangements confirmed with the client.
10.6 While we take reasonable care to retain and deliver digital images as agreed, clients are encouraged to download and save their images promptly once they become available.
11. PHOTOGRAPHY, COPYRIGHT AND MARKETING
11.1 Photographs and digital images produced through the photobooth may contain images of the client and event guests.
11.2 Copyright ownership in photographs and other creative material will be determined by applicable law and any relevant written agreement.
11.3 The client does not automatically acquire copyright ownership of photographs merely by paying for a photobooth service.
11.4 The client is responsible for ensuring that any logos, artwork, branding or other material supplied to Stardust Photobooths for use in a print design or digital template may lawfully be used for that purpose.
11.5 Stardust Photobooths will not use identifiable guest photographs for promotional or marketing purposes without appropriate permission or another lawful basis.
11.6 Where marketing permission is requested, it may be provided or declined separately from the booking agreement. Declining marketing permission will not affect the client’s ability to book our services.
11.7 Clients who have concerns about the use of event photographs may contact Stardust Photobooths to discuss their preferences.
12. PRIVACY AND PERSONAL INFORMATION
12.1 Stardust Photobooths respects the privacy of its clients and takes reasonable steps to protect personal information.
12.2 Personal information collected during the booking process may include names, contact details, event information and payment-related records.
12.3 This information will be used for purposes reasonably connected with managing bookings, providing services, processing payments, communicating with clients and meeting legal obligations.
12.4 Personal information will not be disclosed to third parties except where reasonably necessary to provide the service, where authorised by the individual or where required or permitted by law.
12.5 Stardust Photobooths will take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access or disclosure.
12.6 Clients may contact Stardust Photobooths with questions about their personal information or privacy concerns.
13. CLIENT CONDUCT AND GUEST BEHAVIOUR
13.1 The client is responsible for communicating relevant photobooth rules to their guests and taking reasonable steps to encourage safe and respectful use of the equipment.
13.2 Guests must follow reasonable instructions given by the Stardust Photobooths operator.
13.3 The operator may refuse service to any individual whose behaviour presents a genuine safety risk, involves harassment or abuse, or threatens damage to equipment.
13.4 Stardust Photobooths may temporarily suspend or stop the service if serious misconduct or unsafe conditions make continued operation unreasonable.
13.5 Where reasonably practicable, the operator will inform the client of the issue and provide an opportunity for it to be resolved.
13.6 Any suspension or termination of the service will be handled reasonably, taking into account the circumstances and the parties’ rights under applicable law.
14. OUTDOOR EVENTS AND WEATHER
14.1 Stardust Photobooths equipment is designed for indoor use. Outdoor setups are not permitted unless expressly approved in writing beforehand.
14.2 The client must disclose any venue conditions that could affect the safety or operation of the equipment.
14.3 Stardust Photobooths may refuse to install or operate equipment where conditions are unsafe or unsuitable.
14.4 If an approved setup becomes unsafe due to weather, water exposure, extreme temperatures or other environmental conditions, the operator may pause or stop the service until it is safe to continue.
14.5 Any resulting changes, cancellations or refunds will be handled in accordance with these Terms and Conditions and applicable law.
15. TRAVEL, PARKING AND VENUE EXPENSES
15.1 Any travel fees, parking costs, tolls, venue charges or other additional expenses that apply to the booking will be communicated to the client before the booking is confirmed, wherever reasonably practicable.
15.2 The client must advise Stardust Photobooths of any venue access restrictions, loading zones, parking arrangements or special entry requirements before the event.
15.3 Additional expenses arising from a client-requested change or an unforeseen venue requirement will be discussed with the client before being incurred wherever reasonably practicable.
16. FORCE MAJEURE AND UNFORESEEABLE CIRCUMSTANCES
16.1 Neither party will be considered in breach of these Terms and Conditions to the extent that performance is prevented or delayed by circumstances beyond their reasonable control.
16.2 Such circumstances may include natural disasters, severe weather, fire, serious illness, government restrictions, transport disruptions, power outages or other significant unforeseen events.
16.3 The affected party must notify the other party as soon as reasonably practicable and take reasonable steps to minimise the impact.
16.4 Both parties will make reasonable efforts to agree on an appropriate alternative arrangement where possible.
16.5 If the service cannot be provided, any refund, rescheduling or other remedy will be determined in accordance with these Terms and Conditions and applicable law.
17. LIABILITY AND AUSTRALIAN CONSUMER LAW
17.1 Stardust Photobooths will exercise reasonable care and skill when providing its services.
17.2 Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
17.3 To the extent permitted by law, Stardust Photobooths is not responsible for indirect or consequential loss arising from circumstances outside its reasonable control.
17.4 Nothing in these Terms and Conditions excludes liability for matters where exclusion is prohibited by law.
17.5 The client is responsible for taking reasonable care of their own property and the property of their guests during the event.
17.6 Each party remains responsible for its own acts and omissions to the extent required by law.
18. COMPLAINTS AND DISPUTE RESOLUTION
18.1 If the client has a concern or complaint about a booking or service, they should contact Stardust Photobooths in writing and provide details of the issue.
18.2 Stardust Photobooths will review the complaint and make reasonable efforts to respond and resolve the matter fairly.
18.3 Both parties agree to make reasonable efforts to resolve disputes through communication before pursuing other available remedies.
18.4 Nothing in this section prevents either party from exercising any legal rights or seeking assistance from a relevant consumer protection authority.
19. AMENDMENTS TO THESE TERMS AND CONDITIONS
19.1 Stardust Photobooths may update these Terms and Conditions from time to time.
19.2 The version applicable to a booking will generally be the version accepted by the client when the booking is confirmed, unless a change is required by law or otherwise agreed by the parties.
19.3 Any material changes affecting an existing booking will be communicated to the client, where reasonably practicable.
20. GOVERNING LAW
